{"id":2887,"date":"2022-04-14T01:06:06","date_gmt":"2022-04-14T07:06:06","guid":{"rendered":"https:\/\/freebart.org\/?p=2887"},"modified":"2023-01-21T22:44:29","modified_gmt":"2023-01-22T05:44:29","slug":"2022-april-1-news-article-hoi-abc-news-prosecutors-reject-convicted-killers-new-trial-request","status":"publish","type":"post","link":"https:\/\/freebart.org\/?p=2887","title":{"rendered":"2022 April 1 News Article \u2013 HOI ABC News &#8211; Prosecutors reject convicted killer&#8217;s new trial request"},"content":{"rendered":"\n<figure class=\"wp-block-image size-full\"><a href=\"https:\/\/freebart.org\/wp-content\/uploads\/2022\/04\/image-3.png\"><img fetchpriority=\"high\" decoding=\"async\" width=\"416\" height=\"136\" src=\"https:\/\/freebart.org\/wp-content\/uploads\/2022\/04\/image-3.png\" alt=\"\" class=\"wp-image-2888\" srcset=\"https:\/\/freebart.org\/wp-content\/uploads\/2022\/04\/image-3.png 416w, https:\/\/freebart.org\/wp-content\/uploads\/2022\/04\/image-3-300x98.png 300w\" sizes=\"(max-width: 416px) 100vw, 416px\" \/><\/a><\/figure>\n\n\n\n<p>By&nbsp;<a href=\"https:\/\/www.hoiabc.com\/authors\/darnysha-mitchell\/\">Darnysha Mitchell<\/a><\/p>\n\n\n\n<p><em>Published:&nbsp;Dec. 10, 2021 at 4:50 PM PST<\/em><\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><a href=\"https:\/\/freebart.org\/wp-content\/uploads\/2022\/04\/image-4.png\"><img decoding=\"async\" width=\"975\" height=\"554\" src=\"https:\/\/freebart.org\/wp-content\/uploads\/2022\/04\/image-4.png\" alt=\"\" class=\"wp-image-2889\" srcset=\"https:\/\/freebart.org\/wp-content\/uploads\/2022\/04\/image-4.png 975w, https:\/\/freebart.org\/wp-content\/uploads\/2022\/04\/image-4-300x170.png 300w, https:\/\/freebart.org\/wp-content\/uploads\/2022\/04\/image-4-768x436.png 768w\" sizes=\"(max-width: 975px) 100vw, 975px\" \/><\/a><\/figure>\n\n\n\n<p><a href=\"https:\/\/www.hoiabc.com\/2021\/12\/11\/prosecutors-reject-convicted-killers-new-trial-request\/\" data-type=\"URL\" data-id=\"https:\/\/www.hoiabc.com\/2021\/12\/11\/prosecutors-reject-convicted-killers-new-trial-request\/\" target=\"_blank\" rel=\"noreferrer noopener\">Click HERE<\/a> for link to news piece as it aired on ABC<\/p>\n\n\n\n<p>BLOOMINGTON (Heart of Illinois ABC) &#8211; A Bloomington man serving a life sentence after being convicted of killing his daughter is hoping to find justice for his daughter and be exonerated- but it looks like that process could be delayed.<\/p>\n\n\n\n<p>Bart McNeil, 62, was convicted of killing his three-year-old daughter Christina McNeil in July 1999 and is serving 100 years.<\/p>\n\n\n\n<p>In a hearing Friday, Prosecutor Mary Koll said the state would be filing a motion to dismiss, contesting the evidence that could free McNeil.<\/p>\n\n\n\n<p>McNeil\u2019s legal team of five lawyers from the Illinois Innocence Project and the Exoneration Project attended the hearing on his behalf.<\/p>\n\n\n\n<p>In February, those lawyers filed a 65-page petition detailing why McNeil is innocent of the murder.<\/p>\n\n\n\n<p>In that petition, newly and overlooked evidence challenges claims by a former pathologist that Christina was molested by McNeil before she was smothered.<\/p>\n\n\n\n<p>It also reveals hairs found near Christina\u2019s body were consistent with the DNA of McNeil\u2019s ex-girlfriend Misook Nowlin.<\/p>\n\n\n\n<p>McNeil said in a statement that he is not surprised by the result of the hearing, but he says he ultimately wants justice for his daughter and for ex-girlfriend Nowlin to be investigated as the suspect in his daughter\u2019s killing.<\/p>\n\n\n\n<p>\u201cIt has always been my goal, reversing my wrongful conviction and meet its greater end, justice for Christina has always been all I\u2019ve ever sought,\u201d McNeil said.<\/p>\n\n\n\n<p>Jeff Boyer, who is McNeil\u2019s friend and former co-worker, also attended Friday\u2019s hearing.<\/p>\n\n\n\n<p>He said back when McNeil was convicted, he was shocked because McNeil seemed liked a nice guy would loved and adored his daughter.<\/p>\n\n\n\n<p>\u201cGetting justice for Christina and getting justice for Bart is gonna take some time and if they can go through the process and present their evidence,\u201d Boyer said.<\/p>\n\n\n\n<p>\u201cThen hopefully this man will be set free,\u201d Boyer added.<\/p>\n\n\n\n<p>Nowlin is now serving 55 years in prison for the murder of her mother-in-law Linda Tyda.<\/p>\n\n\n\n<p>The next hearing is set for May 12, where McNeil will make an appearance unless COVID restrictions prevent him from attending.<\/p>\n\n\n\n<p><em>Copyright 2021 Heart of Illinois ABC.
